Tout comme en droit pénal, la récidive constitue une circonstance aggravante en droits de la concurrence (de l’Union et de ses États membres) : elle peut entraîner une majoration de la sanction – l’amende –, parce que, schématiquement, une nouvelle infraction a été commise parle même auteur. Certes simple dans son énoncé, la récidive ne va pas toutefois sans soulever des questions quant à ses conditions posées par les juges de l’Union – in rem, in personam et pro tempore –, à la lumière de certains droits nationaux de la concurrence, notamment.
