La Ley 33/2003, de 3 de noviembre, del Patrimonio de las Administraciones Públicas, sentó las bases normativas para la formulación y desarrollo de una política global relativa a la gestión de los bienes públicos estatales, abordó los diferentes problemas que planteaban las relaciones entre las distintas Administraciones públicas en materia patrimonial, efectuó una revisión de las normas que regían la administración de bienes y actualizó la regulación del patrimonio público empresarial. Tras la promulgación de la citada Ley, que vino a establecer un nuevo régimen jurídico en la gestión del patrimonio público después de casi cuarenta años de vigencia de la anterior normativa, se ha dictado el Reglamento General, aprobado por Real Decreto 1373/2009, de 28 de agosto, que desarrolla la Ley 33/2003, atendiendo tanto a aquellos aspectos cuya regulación se defiere en la ley expresamente al desarrollo reglamentario, como a todas aquellas materias que requieren una más amplia regulación sustantiva y procedimental.
