Die Gleichheit vor dem Gesetz ist eine der zentralen Saulen eines jeden demokratischen Staates. Die Gultigkeit dieses rechtlichen Postulats ist aber dann zu hinterfragen, wenn, begrundet durch das Geschlecht des Opfers und die damit bedingte biologische Unterlegenheit, Ungleichheit statt Gleichheit herrscht. Die Verfasserin geht daher rechtsvergleichend der Frage nach, ob und wie Frauen als besonderes Schutzobjekt strafrechtlicher Normen in der BRD und den Vereinigten Staaten von Amerika behandelt werden. Gerade im US-amerikanischen Strafrecht ist die Frau als Schutzobjekt auch im rechtlichen Bereich anerkannt, da in den USA der Rechtsfeminismus, also die Ubertragung der Frauenbewegung auf das Recht, traditionell stark vertreten ist. Nach einer Einfuhrung in die historische Entwicklung des Schutzobjektes "Frau" und den Rechtsfeminismus geht die Verfasserin sowohl auf das sexuelle und korperliche Selbstbestimmungsrecht der Frau als auch auf ihre psychische und physische Gesundheit ein und erortert hierfur strafrechtliche Normen, die diese zu schutzen suchen. Dafur stellt sie auf den Themenfeldern Vergewaltigung, Hausliche Gewalt, Nachstellung (Stalking), Exhibitionismus, Prostitution, Genitalverstummelung, Abtreibung und Pornographie die wichtigsten Unterschiede zwischen den jeweiligen Regelungen der beiden Lander dar und geht der Frage nach, ob das Strafrecht in seiner heutigen Form fur den Schutz der Frau angemessen oder reformbedurftig ist. Besonders beleuchtet wird die Frage, welches der beiden Lander eine Vorbildfunktion fur den Schutz der Frau eingenommen hat und ob anderweitig deklarierte Schutzguter eine Gefahr fur den Schutz der Frau darstellen.
