Die Überlegung, dass eine Lizenzvergabe Vorteile birgt, die mit einem gerichtlichen Vorgehen nicht erzielt werden können, bildet den Grundgedanken der vorliegenden Arbeit. Auf diese Weise können der wirtschaftliche Schaden einer Patentverletzung begrenzt und zusätzliche Einnahmen erzielt werden. In der vorliegenden Arbeit werden Kosten und Nutzen der strategischen Lizenzvergabe bei grenzüberschreitenden Patentverletzungen gegenübergestellt. Die Transaktionskostentheorie bildet den theoretischen Bezugsrahmen der Arbeit. Anhand dieser wurde der Prozess der Lizenzvergabe in Patentverletzungsfällen in einzelne Prozessschritte unterteilt. Jeder Prozessschritt von der Ermittlung und Entdeckung einer Patentverletzung, dem Umgang mit Patentverletzungen bis hin zur Gestaltung und Sicherstellung der lizenzbasierten Kooperation wurde mit Hilfe einer umfangreichen Dokumenten- und Fallstudienanalyse näher untersucht.
